Emergency Healthcare Rights and the ACA for Immigrants

Emergency healthcare is a critical need for everyone, regardless of their immigration status. In this post, we’ll discuss the Emergency Medical Treatment and Labor Act (EMTALA) and how the Affordable Care Act (ACA) helps lawfully present immigrants access healthcare coverage.

Emergency Healthcare Rights: EMTALA
The Emergency Medical Treatment and Labor Act (EMTALA) guarantees everyone the right to emergency care. Under this law, hospitals are required to treat and stabilize anyone who arrives at an emergency room, regardless of their immigration status or ability to pay. For immigrants without legal status or insurance, EMTALA often serves as their lifeline during critical situations.

ACA Coverage for Lawfully Present Immigrants
The Affordable Care Act was designed to expand healthcare access to all U.S. residents, including some immigrants. Lawfully present immigrants can use the ACA Marketplace to purchase insurance and, depending on their income, receive subsidies. Unlike Medicaid, the ACA does not impose a five-year waiting period on lawfully present immigrants.

Limitations for Undocumented Immigrants
Undocumented immigrants cannot buy insurance through the ACA Marketplace or receive federal subsidies. However, some states, like California, have programs to extend healthcare coverage to undocumented residents.

Emergency care is a right for everyone in the U.S., and the ACA provides opportunities for lawfully present immigrants to obtain affordable coverage. Stay informed about your options and any state-specific programs that may be available.
